I have to agree it is a cakeSorry dude, a Jaffa cake is a cake. It had to be proven in court. If it was a biscuit the company would have had to pay VAT, if it is a cake they didn't. It was finally determined that if it was a biscuit it would go soft when stale whereas a cake hardens. A jaffa cake hardens when stale therefore makes it a cake. There was a court case about it in 1991.
