There has been a case in Lincoln where clearly a roleplay scenario has gone wrong and police got involved ! Most of the case seemed to rest on the premise that :-

“Under English law no one can consent to being seriously assaulted.”

From the report :-
A Lincolnshire man who assaulted a woman will not face jail after telling a judge he thought it was role play.

XXXX admitted slapping the woman’s face but said they often engaged in rough sex after meeting on the dating app Tinder two months earlier.

A judge was shown a number of videos in which the pair had previously filmed themselves inflicting violence upon each other, including firm slaps and punches.

They also admitted tying each other up with ropes and on one occasion using the safety word “egg timer” when things went too far.
XXXX was alleged to have launched a violent attack on the woman after they returned to his flat in Lincoln, following a night out in which they both consumed cocaine and alcohol.

Police were called by neighbours after the woman ran out of the flat in to the street wearing only her bra.

I read this today, she didn't want to press charges but the police were concerned as she had a broken jaw and rib, I would say this is abuse

I think as soon as you introduce drugs and alcohol all bets should be off. I could not be sure that either were in the right frame of mind to consent or understand whether consent had been given. It's a difficult one x

Agree totally but given the lifestyle of many this bit could catch anyone out agreed or not

As far as kink ply goes, a few safety precautions:
1. Ensure some element of trust is built (preferably over time)
2. Ensure all limits are discussed/negotiated and agreed upon.
3. Clarify verbal and non-verbal safewords
4. If the sub says stop... ALL Stop!
5. The Dom is also to check on the sub frequently and often, in order to identify the diffference between sub-space from losing consciousness.
6. Preferably, avoid playing under external chemical influence: both parties.
7. Ensure all play is SSC: Safe, Sane and Consentual (easily the most important)

Sounds like the above stopy missed a few of the basics.

As the first person who introduced me to the scene said: the mistake that non D/s always make about D/s is not realising: the sub is always in ultimate control, because they can say stop/[safeword]

I agree with those who’ve commented above: this wasn’t rough play, this was abuse.

Also, that the moment someone’s ability to consent is removed (through excess drugs or alcohol) consent must be deemed to no longer exist. It might be a truism, but consent presupposes the ability to consent.

A similar thing happened a while ago, can't remember the details now but the decision was that the "attack" was deemed as an assault. I'll try to find the info.
